For individuals seeking work (“Candidates”), use of the Website is provided free of charge. At no point will we ask for payment from you, nor seek any credit card or other payment-related details. If such a request is made of you, please decline and let us know immediately by sending us an email
8. Registration process and security.
You acknowledge that you have provided us with accurate and complete registration information and that it is your responsibility to update us with any changes to that information by logging into the system and making the necessary amendments through ‘My CV’.
For Candidates: each registration is for a single user only. On registration, you will be allocated a user name and password (“ID”). You are responsible for all use of the Services using your ID and for preventing unauthorised use of your ID.
If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID, you must notify us immediately by sending us an email. If we reasonably believe that your ID is being used in any way which is not permitted by the Terms, we reserve the right to suspend access rights immediately on giving notice to you and to block access from your ID until the issue has been resolved.
9. Intellectual Property Rights.
Subject to your rights in your information set out in clause 2 , you agree that all trade marks and copyright, database rights, design rights and other intellectual property rights in the Content (as well as the look and feel, organisation and layout of the Website) together with the underlying software code are owned by us and/or our licensors (as the case may be) and in any event are subject to any restrictions or prohibitions imposed by us or the owner(s) of such information (whether directly or indirectly). You also agree that any information in a non-public area of the Website (including without limitation that intended for use only by authorised user(s), and/or requiring some form of password or other code) is strictly confidential.
10. Liability.
You understand and acknowledge that we provide the Website only as a gateway for users to review opportunities in and information about the housebuilding sector and we do not seek to or have any control (beyond the limited editorial rights pursuant to the Terms) over submissions or their accuracy, quality or truthfulness, and nor do we have any involvement in the negotiation or conclusion of any contract of employment arising from any information submitted to the Website. Accordingly, but subject at all times to the last sentence of this clause, we accept no liability for any loss (whether direct or indirect, for loss of business, revenue or profits, wasted expenditure, corruption or destruction of data or for any other indirect or consequential loss whatsoever) arising from your use of the Website and we hereby exclude any such liability, howsoever arising, whether in contract, tort (including for negligence) or otherwise. Except for the express provisions of the Terms we exclude all warranties, terms and other conditions, including but not limited to any warranty, term or other condition of merchantability, satisfactory quality, fitness for a particular purpose or non-infringement in every case whether implied by statute, common law, custom, collaterally or otherwise. Nothing in the Terms limits liability for death or personal injury caused by negligence, or fraud.
11. Indemnity.
You shall indemnify and hold harmless us and our officers, employees, directors, shareholders, representatives, successors and assignees against any and all costs, expenses (including reasonable legal expenses), claims, losses, liabilities or proceedings arising from the use or misuse by you of this Website. You agree to notify us together with all relevant facts if anyone makes or threatens to make any claim against you relating to your use of this site.
Recruiter Terms And Conditions
General
In these terms and conditions:
1. References to 'we', 'us' or 'our' are references to New Homes Jobs;
2. 'Advertiser' means any person, company, organisation or firm which purchases Services from us;
3. 'Services' means all recruitment products and services made available by us from time to time;
Prices
Prices are guaranteed for the period stated on the Invoice. Prices are confidential and may not be disclosed by the Advertiser. A job posted on New Homes Jobs.com will remain live for 28 days or such shorter time as we agree with the Customer. Any extension of this time will be charged to the Customer as a new posting. Any jobs posted in addition to the agreed number of jobs per 28 day period will be charged at a price per job agreed with the customer at the time of the contract negotiation. If no price has been negotiated, Rate Card will be charged for each job over the agreed number.
Termination
The Customer may terminate the provision of Services under any Order Form by no less than 30 days notice to expire at the end of a Contract Month. Termination by the Customer before the end of the Contract Term may, at our discretion, result in loss of discounts agreed for the entire Contract Term.
We may terminate the provision of Services if:
· the Customer is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
· the Customer becomes insolvent, ceases to trade or goes into liquidation.
Limitation of liability
Our total liability to the Customer in respect of any Services, except for death or personal injury caused by our negligence, is limited to the total amount paid to us during the Contract Term for such Services or £1,000, whichever is the lesser.
Third Party Sites
Vacancies you post on New Homes Jobs.com may also appear on third party recruitment web sites pursuant to agreements from time to time between New Homes Jobs.com and the proprietors of such web sites.
Use of candidate database
Employment agencies and employment businesses
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 (“the Act”) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 1976 and (when they come into force) 2001. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.
You may NOT:
· Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.
· Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.
Dealings with candidates
You agree to deal fairly and professionally with individuals you may contact using information from the candidate database and not do anything which may bring New Homes Jobs into disrepute. You will indemnify New Homes Jobs from and against any claim brought by an individual against New Homes Jobs arising from your breach of this obligation or any other of these terms and conditions.
Online Advertising
1. For companies seeking candidates (“Advertisers”), the Services are subject to our separate Business Terms which can be seen below. Payment terms are detailed therein.
2. The services shall commence on the “Contract Start date” which shall be defined as the date that both parties agree that the content on the site is satisfactory.
3. The fee shall be payable upon presentation of an invoice by New Homes Jobs.
4. The Services shall comprise access to the purchased service, as requested, the client shall provide any information or copy promptly. The client shall use reasonable endeavors to ensure the truth and accuracy of information supplied or inputted by the client. The client understands that to the extent that any additional Services are offered to it, New Homes Jobs may charge for them additionally.
5. New Homes Jobs may issue a unique password to the client. This password shall not be transferred or misused under any circumstances. If for any reason, a third party has gained unauthorized access to your account, please contact New Homes Jobs immediately.
6. Both parties shall observe obligations under the Data Protection Acts 1984 and 1998 and any other privacy laws. Where the candidate sends information through to the client, the information should only be used for the express purpose in which is was sent.
7. New Homes Jobs shall not undertake liability beyond subscription cost
8. For any of the following:
loss arising from information inputted, received, available at, linked to or removed from the Site howsoever occurring, but subject to reasonable endeavors by New Homes Jobs to correct any error within 7 days of its notification to New Homes Jobs
-special, indirect or consequential loss, including, without limitation, loss of information, profit, contract, anticipated savings or opportunity;
-interruption to the Services or access to the Site as a result of events beyond your reasonable control or, where New Homes Jobs is at fault, for any period not exceeding 7 consecutive days inclusive.
9. Nothing in this sub-paragraph 9 shall serve to limit New Homes Jobs’s liability
-for fraud or personal injury or death arising from your negligence or that of your agents or servants.
10. Both parties shall keep confidential any confidential information which has been or is disclosed to it by the other. Confidential information includes, without limitation, information as to business methods, dealings or plans, not known to the other prior to disclosure or in the public domain or required to be disclosed by any court or regulatory authority.
11. Any sums due under the agreed purchase order are payable without deduction or set off within 14 days, after which interest shall be payable on all outstanding sums at 3% above the base rate of National Westminster Bank from time to time.
12. The purchase order and terms and conditions contain the client’s entire agreement (other than in the case of fraud) and exclude all pre-contractual representations (including any implied at law so far as legally permissible).
13. The details of this Confirmation Order shall remain confidential.
14. Miscellaneous terms.
The Terms may be changed by us at any time. You will be deemed to accept the Terms (as amended) when you next use the Website following any amendment.
Headings are inserted in this Agreement for ease of reference only and do not form part of it for the purposes of interpretation.
Failure by us to exercise or enforce any rights conferred by the Terms or at law shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof at any time or times thereafter.
Any notice to be given by either party shall be in writing and delivered personally or sent by pre-paid recorded delivery or registered post or by fax to our registered address or where applicable to you at the address in your information.
If any provision of this Agreement is determined to be illegal or unenforceable by any court of competent jurisdiction it shall be deemed to have been deleted without affecting the remaining provisions.
The Terms supersedes all prior agreements and arrangements of whatever nature and sets out the entire agreement and understanding between you and us relating to its subject matter.
New Homes Jobs. reserves the absolute right, without giving any reasons,
to decline, cancel or remove any Advertisement or provision of Services for
any reason and at any time without prior notice.
For Advertisers: each Subscription is for a single organisation only as included
in your registration information. On registration, you will be allocated a
user name and password (“ID”). You may choose to authorise your
employees (together “Users”) to use your ID whilst carrying out
the business of your organisation. You are responsible for all use of the
Services by all such Users and anyone else using your ID and for preventing
unauthorised use of your ID.
